The Founders limited “treason” in the Constitution due to grave concerns it would be weaponized to criminalize dissent: exactly how the term is now routinely used.
Editor’s Note: This long, and very thorough discussion of Romney’s accusation of Tulsi Gabbard as a “traitor” is worth looking at. It includes a lot of detail and background information including a definition of what a traitor is according to the U.S. Constitution and the reasons the definition is narrow and definite. A couple of key phrases Greenwald builds to are: “Romney’s accusation that Lt. Col. Gabbard is guilty of treason is repugnant and false for numerous reasons,” which Greenwald then goes on to explain.
