ICE Sued for Hiding Data on Sanctuary Cities’ Non-Cooperation

The U.S. Immigration and Customs Enforcement (ICE) is the subject of a new lawsuit by a group that advocates for stricter immigration laws.
Attorneys for the Immigration Reform Law Institute (IRLI) filed suit in the U.S. District Court for the District of Columbia, alleging that ICE has failed to comply with a Freedom of Information Act (FOIA) request.
The records in question concern “detainer” requests.
A detainer request occurs when federal officials ask local agencies to notify ICE before releasing an illegal alien, while having them maintain custody for a short time so that ICE may remove them.
IRLI wants to know how often local governments fail to honor these requests and seeks records for all 50 states.
In addition, IRLI wants records detailing arrests of illegal aliens that occurred after they were released.
The complaint alleges that ICE failed to comply with IRLI’s FOIA request within the 20-day deadline and asks the Court to order production of the records.
The case is FAIR v. U.S. Immigration and Customs Enforcement.
“The American people have been kept in the dark when it comes to data on how many ICE detainers are being ignored by local law enforcement,” said Dale Wilcox, IRLI’s executive director and general counsel. “As we have recently seen in California, politicians with open borders agendas are actively thwarting federal immigration enforcement efforts … people need to know the pervasiveness of this obstruction.”
Refusing to comply with detainer requests is a hallmark of “sanctuary city” policies.
Perhaps the most notorious denial of such a request came in San Francisco, resulting in the release of Jose Garcia Zarate, which led to the “accidental shooting” death of Kate Steinle.
And last month, officials in the city of Denver made national news when they refused to honor a detainer request for an illegal alien who was arrested in connection with a fatal hit-and-run.
