Reps. Black, Poe: Enough of ATF’s ’20 Questions’ on Gun Buys

The Obama administration’s palpable disdain for the Second Amendment needs to be stopped, says Texas Rep. Ted Poe, who with Tennessee Rep. Diane Black is introducing a bill to halt the requirement that people purchasing firearms disclose their race and ethnicity.

“By their actions, they don’t like the Second Amendment, any part of the Second Amendment,” Poe said of a 2012 requirement that gun buyers disclose such personal details on Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) forms when making a purchase.

“It’s all about trying to control the Second Amendment through executive administrative regulations because they never passed anything legislative, and so they use the ATF.”

Black and Poe appeared together Wednesday on “America’s Forum” on Newsmax TV to discuss their FIREARM — Freedom From Intrusive Regulatory Enforcement of Arbitrary Registration Mandates — Act to remove the requirement from the ATF’s Form 4473.

Requiring Americans to disclose their race and ethnicity is tantamount to racial profiling, Black said, pointing out that the ACLU has issued a statement saying there is nothing that supports the requirement for the ATF to collect race-based information.

“So, even the ACLU agrees with us that this is wrong … what we’ll be doing is working very hard to get co-sponsorship and then get our leadership to bring this to committee,” she said.

Poe said the current disclosure is “an effort by the administration, by any means necessary, to stop the lawful sale of guns and stop the lawful … [right] to possess those firearms.”

The FIREARM Act will protect the American people so they are free to exercise their Second Amendment rights, said Black.

“Americans shouldn’t have to play 20 questions with Uncle Sam just to get access to their constitutionally protected freedom,” she said.
