Dem outrage over Education Department plans shows where their priorities are: ExpertThe Department of Education (DOE) is canceling more than $100 million in grants to fund diversity, equity, and inclusion (DEI) training as part of the Department of Government Efficiency (DOGE) sweep of “wasteful” spending. DOGE, the department led by Elon Musk to cut costs within the federal government, announced the termination of 89 DOE contracts totaling $881 million in a post on X Monday night.

Of the nearly $1 billion, DOGE identified $101 million that was being used for DEI training, including teaching educators to “help students understand/interrogate the complex histories involved in oppression, and help students recognize areas of privilege and power on an individual and collective basis.”

“Your tax dollars were spent on this,” Musk wrote of the DOE spending.

According to DOGE, the education department spent another $1.5 million on a contractor to “observe mailing and clerical operations” at a mail center, which was also terminated in the recent spending sweep.

“DEI was never about ‘equity’—it was about enforcing ideological conformity and institutionalizing discrimination. Shutting down these wasteful, divisive programs is a win for every student,” Nicki Neily, founder and president of Parents Defending Education, said in response to the spending cut. 

“More states need to follow suit,” Neily said.

DOGE has been leading efforts to vacuum spending within the DOE, announcing in early February the termination of three grants including one funding an institution that had reportedly “previously hosted faculty workshops entitled ‘Decolonizing the Curriculum.'”

Amid the Trump-Vance crackdown on certain teachings, several colleges, such as Missouri State University and West Virginia University, have begun closing their DEI offices.

On Sunday night, the administration filed an emergency motion to vacate an ex parte temporary restraining order issued by Obama-appointed Judge Paul A. Engelmayer from the U.S. District Court for the Southern District of New York.

Engelmayer’s order, issued in the dead of night on Saturday, effectively blocks the Department of Government Efficiency (DOGE)—led by Elon Musk—and even Treasury Secretary Scott Bessent from accessing key Treasury Department payment systems. These systems handle everything from tax refunds to Social Security benefits, disability payments, and federal employee salaries.

But here’s the kicker: this wasn’t just any court order. It was an ex parte order, meaning Trump’s legal team wasn’t even in the room. No notice, no argument—just a one-sided hearing where only Democrat attorneys general got to plead their case. If that sounds shady, that’s because it is.

Even more outrageous, the judge didn’t stop at limiting access. He ordered the immediate destruction of any information DOGE had accessed since January 20—the day Trump was inaugurated.

The Trump administration’s emergency motion argues that this order violates Article II of the Constitution, which establishes the President’s authority over the executive branch. The motion pulls no punches, calling the judge’s decision a “remarkable intrusion” on executive power, with the potential to cause “irreparable harm” to the government’s ability to function.

“There is not and cannot be a basis for distinguishing between ‘civil servants’ and ‘political appointees,’” the motion states. “Basic democratic accountability requires that every executive agency’s work be supervised by politically accountable leadership who ultimately answer to the President.”

Vice President JD Vance weighed in on the situation with a blistering post on X:
“If a judge tried to tell a general how to conduct a military operation, that would be illegal. If a judge tried to command the attorney general in how to use her discretion as a prosecutor, that’s also illegal. Judges aren’t allowed to control the executive’s legitimate power.”

This isn’t just a legal battle—it’s a fight for the very foundation of our constitutional system. The separation of powers exists for a reason, and if rogue judges can block the President from overseeing his own departments, we’ve got a serious problem.

The hearing is scheduled for February 14, but the Trump administration is demanding immediate action to dissolve this anti-constitutional order. As they should. The executive branch doesn’t answer to activist judges—or to Letitia James.

It answers to the American people.

Alan Dershowitz© The Daily Caller – Attorney Alan Dershowitz said Monday that many of the injunctions blocking actions by President Donald Trump, ranging from his executive orders to his efforts to address wasteful and fraudulent spending, will be thrown out on appeal.

The Trump administration is appealing injunctions imposed by federal judges that targeted the Department of Government Efficiency (DOGE) and Trump’s Jan. 20 executive order ending birthright citizenship, among others. Dershowitz said during “The Dershow” that the cases will eventually be resolved by the U.S. Supreme Court.

“Nobody ever said that our system of checks and balances would make it easy to govern or would make it efficient to govern. No, no, the design of our system of checks and balances was to create enough power to govern effectively while, at the same time, denying any one part of our government enough power to create a tyranny. So we have to counter our system of checks and balances, and it’s working, even today, as we speak,” Dershowitz said. “The president issues executive order after executive order after executive order, and what do the states do? They get their attorneys general to bring a lawsuit.”

They file the lawsuits, and you get judges saying, ‘Uh-uh, no, Mr. President, you can’t do that,’ and so you get a single judge for about an hour being able to stop the president from doing something. I say an hour metaphorically. It could be days, but ultimately those issues are brought up to the court of appeals and eventually to the Supreme Court. It will be resolved, and the president will obey, wouldn’t do what Andrew Jackson did, saying, ‘The chief justice made the ruling, now let him enforce it,’” Dershowitz said.

United States District Judge John J. McConnell Jr. of the District of Rhode Island threatened Trump with criminal contempt charges over the spending freeze Trump ordered.

“President Trump has never defied a court order, and he has indicated that he would comply with court orders, but he needs to know that he has the right to appeal these court orders. Many of them will be found to be improper. The courts don’t have the power to stop this or stop that,” Dershowitz said.

Dershowitz also took aim at Democrats who joined protests outside the headquarters of the United States Agency for International Development and the Treasury Department Tuesday after Tesla CEO Elon Musk announced plans to close down the former agency in his capacity as chairman of DOGE.

People keep forgetting, the bureaucracy, the bureaucracy, the alphabet agencies. They are not an independent branch. They are part of the executive, and the executive is the president. Now, it’s complicated, because Congress created many of these agencies,” Dershowitz said. “For example, you know some of them, Federal Communications Commission, federal security, federal drug, those are created by Congress, but they’re part of the executive department. Some of the people are confirmed by Congress, and so your argument is you can’t fire them, only Congress can unconfirm them, but that’s never been the rule. For example, the head of the FBI is confirmed, and all cabinet members are confirmed by the Senate, yet the president can fire any of those heads of agencies at his whim. He doesn’t even have to have a reason to do it.”
