Where is the Supreme Court?

Biden/Obama are not following the Constitution which states the government must provide protection from foreign invasion and domestic violence to all states..

At its core, the Guarantee Clause provides for majority rule. A republican government is one in which the people govern through elections. This is the constant refrain of the Federalist Papers. NEW YORK CITY, NEW YORK: On Thursday, December 28, in a letter to Texas Republican Governor Greg Abbott, the Biden administration threatened legal action if the state enforces a recently enacted law that grants authorities the power to arrest, jail, prosecute, and deport migrants who enter the country illegally.

Following this news, Fox News host Laura Ingraham took to X, formerly known as Twitter, to slam the administration, labeling it the “Biden Regime.”

Many users on X agreed with Ingraham’s remarks and expressed their opinion on the issue, slamming the Biden administration in the process.

Fox News host Laura Ingraham took to X and wrote, “The Biden Regime will fight anyone who slows down the incoming flow because the goal is to completely transform America.”

Ingraham’s tweet also linked an article from the New York Post titled, ‘Biden admin threatens to sue Texas if state arrests and deport migrants.’

In the article, it was reported that the Biden admin has issued a warning to Texas Governor Greg Abbott that they “intend to file suit” against the state if they try to arrest, jail, prosecute, or deport migrants.

In a letter sent to Abbott, a Justice Department official asserted that the recently enacted law, known as SB4 or Senate Bill 4, is “contrary to the US commitment of ensuring the processing of noncitizens consistent with the Immigration and Nationality Act.”

This law is a component of the state’s Operation Lone Star, launched by Governor Abbott in March 2021, and is scheduled to take effect on March 5, 2024.

Principal Deputy Assistant Attorney General Brian M Boynton wrote, “SB 4 is preempted and violates the United States Constitution. Accordingly, the United States intends to file suit to enjoin the enforcement of SB 4 unless Texas agrees to refrain from enforcing the law,” as reported by CBS News.

SB 4, signed into law by Abbott on December 18, criminalizes illegal entry into the United States from Mexico as a state offense.

Additionally, it grants authorization for police to arrest individuals suspected of crossing the Rio Grande between designated ports of entry.

Under SB 4, migrants apprehended for illegal entry into the country would face a Class B misdemeanor charge, which carries a potential sentence of up to six months in jail.

Repeat offenders could be charged with a second-degree felony, carrying a maximum prison sentence of up to 20 years.

The law also empowers Texas judges to dismiss charges against migrants if they agree to be deported.

Justice Department official Boynton argues that this new law “intrudes into a field that the federal government occupies.”

He added, “Indeed, the Supreme Court has confirmed that ‘the removal process’ must be ‘entrusted to the discretion of the Federal Government’ because a ‘decision on removability’ touches ‘on foreign relations and must be made with one voice.'” 

The DOJ official highlighted a concern that SB 4 might result in the imprisonment or deportation of migrants with valid asylum claims, exposing them to the risk of persecution or torture in their home countries.

The Biden administration has requested Abbott to confirm by January 3 that he will not enforce the new law, stating that if they do not, “the United States will pursue all appropriate legal remedies to ensure that Texas does not interfere with the functions of the federal government.”

In response, Abbott criticized the threat on social media, accusing Joe Biden of “destroying America” and expressing frustration with what he perceives to be the administration’s reluctance to enforce existing immigration laws.

Abbott wrote, “The Biden Admin. not only refuses to enforce current U.S. immigration laws, they now want to stop Texas from enforcing laws against illegal immigration. I’ve never seen such hostility to the rule of law in America. Biden is destroying America. Texas is trying to save it.”
